
An emergency regulation approved by the Nevada Board of Medical Examiners allowing medical assistants to give flu shots has been blocked because of Open Meeting Law concerns.
Clark County District Judge Kathleen Delaney signed a temporary restraining order Monday, halting the regulation from taking effect until a hearing Sept. 29.
The medical board, meeting in Reno on Friday, passed the emergency measure sought by Gov. Jim Gibbons, who feared there wouldn't be enough health care professionals to inoculate people during the upcoming flu season unless the regulations were clarified.
But Las Vegas lawyer Jacob Hafter challenged the approval. He argued the vote violated the Open Meeting Law because it was taken before all public comments were heard to accommodate some members who had to leave for luncheon engagements.
