Judge's Son Released from Custody

There have been allegations that Mosley and another driver were street racing when the other driver lost control of his vehicle and flipped over, killing Olivia Hyten. A local teen arrested after a deadly crash is being released from juvenile custody. 16-year-old Michael Mosley, son of District Court Judge Donald Mosley, will be going home. He was involved in a deadly crash that killed 15-year-old Coronado High School student Olivia Hyten.

Mosley will be released, but under the judge's order he will be under house arrest with a GPS tracking unit.

There have been allegations that Mosley and another driver were street racing when the other driver lost control of his vehicle and flipped over, killing Hyten. Although Mosley was not the driver of the car that rolled, police did find alcohol in his system as well as a spring loaded knife.

Mosley has been previously charged with reckless driving and possession of a firearm. Several months ago, he was found with an airsoft pellet gun on school property.

Both of Mosley's parents were in court pleading with the judge for their son's release.

"He has not been convicted of anything and I would ask that if you remand him to his parents. I took a photograph here of the cars in my home. They are all locked together. There is no vehicle that will be available to my son -- no drinking. And I assure you he will be in court when he needs to be," said Judge Mosley.

Michael Mosley has not been officially charged with DUI. He was held in juvenile custody for a week because he broke a court order from a past charge. Under that order, he was only allowed to drive to and from school and was not allowed to have friends in the car.

The district attorney's office says they are still waiting on the Henderson Police Department to finish up their accident investigation. Mosley could be charged with reckless driving or even involuntary manslaughter depending on what the investigation reveals.

The DA says at the very least, he will be charged with DUI in the future.

The driver of the other vehicle that Olivia Hyten was actually riding in has not been charged. The district attorney says they are also waiting on the Henderson Police Department to decide what charges to bring forward on the other driver.

They believe that investigation might be wrapped up some time next week.
