Thirteen-year-old Fabriccio Patti was shot in the back as tried to run from a smoke shop after attempting to steal merchandise, according to the arrest report.

Patti's autopsy showed he was shot seven times from back to front, the report said.

Store clerk Raad Sunna, 24, is charged with murder in the death of Patti following the Dec. 2 shooting at the Lucky's Cigar & Smokes on Flamingo Road near Durango Drive.

On the night of the shooting, Sunna called the police and waited outside for them to arrive. He told police one of the teens ran towards him and he drew his firearm and began shooting. Sunna said he believed he was about to be robbed or killed and was in fear for his life, the report said.

The report also details how the teens met after school near the shop and one of the teens suggested they steal a bong, which is used for smoking. The teens covered their faces with clothing and hoodies to conceal their identities. Two teens entered the store and one stayed outside holding the door.

The arrest report also details what detectives viewed on the surveillance video inside the smoke shop. According to the report, the video shows both teens about 40 feet away from Sunna and not approaching him as he indicated to police. Patti was taking items off the wall when he was shot.
