LAS VEGAS -- A judge agreed Friday morning to let an independent lab review blood samples taken from Gary Hosey Jr., the driver who crashed into a bus stop killing four people last September.
The deadly crash happened in the early morning at a bus stop near Spring Mountain Road and Decatur Boulevard. Hosey appeared in Clark County District Court in a black jumpsuit with his hands shackled around his waist. His DUI trial was supposed to start next month but has been postponed.
There has been debate over Hosey's blood test results and whether he was over the legal limit at the time of the crash. One blood test done two hours after the crash showed Hosey's blood level at .06. Prosecutors said blood alcohol levels decrease over time and Hosey's blood alcohol content could have been above the legal limit of .08 at the time of the incident.
Prosecutors also allege Hosey did test above the legal limit for marijuana.
There will be another status check on the case on June 7 to review the results of the blood sample testing, which was authorized Friday in Clark County District Court.
