Erik Scott's Attorney Files Motion to View Evidence

LAS VEGAS --  Ross Goodman, the attorney for Erik Scott who was shot to death by Metro police, has filed a motion to review the evidence in this case.

Goodman filed the motion Wednesday to have Scott's family attend a pre-inquest hearing. The shooting is scheduled for a coroner's inquest on Sept. 22.

Scott was shot and killed by police on July 10, 2010 in front of the Summerlin Costco. The shooting set off a community controversy over police shootings and the coroner's inquest process.

The motion states that the State has the opportunity to bring any evidence or testimony before a coroner's jury, "regardless of whether it complies with the rules of evidence and without it being subject to cross-examination or rebuttal by the family."

The Scott family is asserting that Metro is concealing a surveillance video tape. The motion is seeking that the family be allowed to view Scott's autopsy report, crime scene reports, 911 recordings and the video.
