Family of deadly nightclub shooting victim suing club and Bally's

LAS VEGAS -- The family of a man who was killed during a shooting at a Strip nightclub has filed a lawsuit against the owners of the club and Bally's Las Vegas, where the club is located.

The family of Kenneth Brown filed the suit in district court earlier this week, accusing Drai's Management Group and Bally's Las Vegas of negligence and wrongful death.

The shooting happened outside Drai's After Hours in October 2013. According to Metro Police, 41-year-old Benjamin Frazier got into an argument with the club's manager over the cover charge. Police said Frazier took out a gun, shot the manager in the arm and a security guard in the stomach.

Brown tried to wrestle the gun away from Frazier, which is when he was shot and killed, police said.

A trial date for Frazier is set for January 2015.
