Family of elderly man assaulted, outraged on possible parole of attacker

LAS VEGAS - An elderly man's attacker could be released from prison this month. 

"He uses a walker to this day. His ability to do things he enjoyed like play golf, ride bicycles, those are nonexistent anymore," said Peter Hitechew. 

Perry Hitechew called his 92-year-old grandfather, Robert, a friend. Robert has lived in Las Vegas for 55 years and is also a World War II veteran. 

"These golden years have not been so golden due to this and there's nothing I can do to undo that," said Hitechew.

Hitechew can't change the past, but he hopes to change the future by telling his story. Robert was attacked and robbed while walking home two years ago. 

Herbert Jackson Jr. and a 15-year-old boy were arrested.

"Mr. Jackson and his accomplice stalked him across the street and waited until he got into a residential area outside of prying eyes and came up from behind him and hit him on the head from behind," Hitechew said. 

They also broke Robert's hip and leg, he now lives in an assisted-living facility. 

This wasn't Jackson's first run-in with the law. In 2008, he was charged with a crime against a person 65 years or older.

"This man chooses these victims carefully. He goes after elderly people because he thinks they're soft and they're vulnerable and it's an easy mark for him," he said. 

Hitechew's frustration grew when he learned Jackson could be released from prison within the next 30 days and his family didn't have a say.

"Mr. Jackson does not deserve to spend the holiday with his family. He hasn't earned that right," he said. "When there's an assault or any kind of violent crime and there's interested family members who'd like to speak on behalf of that, I would like there to be an opportunity to plead our case."

Hitechew hopes tougher laws involving the elderly will be implemented so another family won't have to go through what his did.
