Husband, Father of TB Victims Files Lawsuit

LAS VEGAS -- A man who lost his wife and twin babies is suing Summerlin Hospital after his dreams of raising a family were destroyed.

Ruben White's attorney, Robert Cottle, said medical staff at the hospital failed to diagnose his wife's tuberculosis which resulted in Vanessa White's death and the death of one of the babies, Abigail. The other baby, Emma, who was premature, died before ever being tested.

Vanessa White's tuberculosis resulted in dozens of other people testing positive for the disease. The results have not yet been released for 140 babies who were in the Neo-Natal Intensive Care Unit around the times Vanessa had visited her daughter over the summer. During those visits, Vanessa was suffering with symptoms including a fever.

Cottle said numerous tests were done on the 25-year-old woman but she was never diagnosed.

A report by Nevada's Bureau of Health Care Quality and Compliance claimed Summerlin Hospital did not take basic steps to prevent the outbreak of tuberculosis. Cottle said he is seeking a hundreds of thousands of dollars in damages.

"That's something I have to deal with everyday, come home to an empty house everyday and having the what could have beens that aren't there anymore," Ruben White said.

Valley Health System which operates Summer Hospital issued the following statement:

"We wish to express our deepest sympathies to Mr. White and his family. Summerlin Hospital is committed to providing the highest level of care, and to provide a safe environment for its patients and visitors. We use nationally recognized protocols to prevent the spread of infection and we are confident we did so in this case.Medical experts who have already reviewed this matter have confirmed there was no reason to suspect that the patient had TB and an appropriate screening was performed."
