I-Team: School District Stalking Case Moving Forward

LAS VEGAS -- The Clark County School District will have to answer for its alleged failure to protect a parent from an employee.

A judge ruled Friday that a lawsuit filed against the district in 2008 will move forward.

In 2009, Andreana Leonard, a mother, was a regular classroom volunteer.

She claimed a teacher she'd dated briefly was stalking her and that she wasn't his first victim.

To save other women, Leonard filed a lawsuit against the school district, alleging it knew the teacher was a threat but did nothing to protect her.

The teacher in question, who has since retired, is Ken McFate.

During the course of the I-Team's investigation, a half dozen restraining orders against McFate were uncovered, spanning over a decade.

Some involved families at his former school in Indian Springs and another by a teacher's aide at the elementary school where Leonard volunteered.

On Friday a judge considered whether to allow the case against the district to move forward.

Although he dismissed some claims, Leonard will be allowed to argue before a jury that the district failed to properly supervise McFate.

"This is something where a parent volunteering at a school came into contact with somebody who had a known history of abuse and stalking," said Leonard's attorney, Richard Segerblom. "The school district's position is they have no obligation to supervise that teacher or inform the parent. And I don't think that's right."

The district insists it cannot and should not get involved in the private lives of its employees and that it is not responsible for McFate's behavior.

The case is set for trial in January. The judge encouraged both sides to talk settlement sooner rather than later.
