LAS VEGAS (AP) -- Two Las Vegas brothers aged 13 and 15 appeared in Clark County Juvenile Court Monday morning and were ordered to remain in custody.
They face battery charges in the beating of a special needs student that was recorded and uploaded to YouTube.
Clark County School District police said the brothers kicked and punched the victim several times outside an apartment complex.
Taking off his glasses and wiping away tears, the boys' father, Joe Luna defended his sons.
"Those boys aren't bad," he said. "They're not. They're not thugs."
The boys' mother said she believes her 15-year-old son egged on her younger son after past bullying from other students.
"He finally just gets tired and you can see it's building up, because he gets frustrated and he says' I can't hear, I can't think. It's too much, Mom,'" the boys' mother, Donna Hernandez said. "Somebody will just push for the last time and he just lashes out."
Hernandez and Luna said their sons have lived a violent life. Luna said he and Hernandez divorced because of his alcoholism and domestic violence. The boys also witnessed their parents being shot and nearly killed during a home invasion robbery several years ago, the parents said.
"I was shot in the head," Luna said. "My wife got her foot shot off."
Video of the incident captured by another male and posted on YouTube Wednesday. The video went viral with more than 50,000 views before it was removed.
The parents said they take full responsibility for their sons' actions and apologized for them.
Elaine Sams, mother of the boy who was attacked, said she hopes the video reminds parents that bullying can be corrected at home before it becomes violent on the streets.
"I understand that you're sorry," Sams said of Hernandez's apology. "I appreciate it. I accept your apology. That's fine. That's not the issue. I get it. But we have to parent the best we know how to parent."
Luna and Hernandez were not present in court. The boys' next court date in Wednesday, Dec. 5.
