Judge Orders Doctor in Fraud Case Be Granted Immunity

A federal judge has ordered the U.S. Attorney's office to grant immunity to a local surgeon. It's part of the so-called medical mafia conspiracy case involving local doctors and lawyers.

Sources close to the case say Judge Justin Quackenbush ruled Monday that Las Vegas doctor, Mark Kabins, should be given immunity to testify in the re-trial of attorney Noel Gage. The judge said if immunity is not given to Kabins, he will throw out the case against Gage.

Kabins has indicated that he would tell the court that neither he nor Gage did anything wrong in their handling of a personal injury case.

Since Kabins is himself a target in the ongoing federal investigation, he will not testify unless he gets immunity.

The U.S. Attorney's office is not commenting on the ruling or how it plans to respond.

Noel Gage is scheduled for re-trial at the end of May. Alleged co-conspirator Howard Awand is set for trial in the fall.
