Lawsuit in Summerlin Hospital TB Case Moving Ahead

LAS VEGAS -- The lawsuit brought by families exposed to tuberculosis at Summerlin Hospital will go forward after a judge denied a defense motion to dismiss the lawsuit.

According to the lawyers for the plaintiffs, the judge denied the defense motion to dismiss, during a hearing Tuesday.

The decision allows plaintiff's attorneys to find people impacted by the outbreak at the hospital's Neonatal Intensive Care Unit this past summer.

Callister and Associates is asking anyone who knows they were exposed to TB or think they might have been exposed at the hospital between May and August 2013 to contact their offices. So far, nearly 200 people have signed on saying they have been impacted by the hospital's practices.

A woman with the disease and her infant twins, one of which turned out to also have the disease, were in the NICU during that time period. The woman and one of her babies died from TB. The second infant also died.

A state report showed the hospital did not take basic precautions to stop the spread of the contagious and potentially deadly disease.

As of January, 61 people connected to the Summerlin Hospital NICU had been diagnosed with TB.
